CUSTOMER TERMS AND CONDITIONS
Pacific Precious Metals ("PPM" "us" or "we") prides itself on providing high payouts, quick turnaround, and satisfied customers. To help assure that we serve you in a way that meets your expectations, we have established these terms and conditions of our service to govern our relationship with our customers. By submitting your precious metal items to us, you agree that these terms and conditions, along with other notices to you on the PPM website, make up the contractual agreement between you and PPM. In these terms and conditions, the term "you" refers to our customer, who has submitted precious metal items to PPM for evaluation and purchase.
1. Our Customers. You represent and warrant that to your knowledge and belief all the information you provide to us on our website and on the documents we send to you are true and complete. You are at least eighteen years of age. As our services are governed by California Law (Business and Professions Code 21628) you must provide us with a sworn statement, government issued ID, and fingerprint. At any time, we may request additional documentation from you to verify your age and identity. We will ask that you verify your age and identity by entering your age and identifying information on our website and on all documentation sent to you as part of the purchase and sale process. You promise to us, and represent and warrant, that items that you send to us for evaluation and potential purchase belong to you and that no other person has any right to or any ownership or security interest in such items. If you break this promise and / or someone else claims an ownership, security or other interest in the items, you will indemnify, defend, and hold PPM and its officers, directors and employees, harmless from any claims brought by such third party, including claims of ownership of any of the items.
2a. Purchase of Precious Metal Bullion bars/coins. When we purchase and receive your bullion bars or coins, we will evaluate them for authenticity and precious metal content using a variety of methods. Our payment to you will be based upon the locked in price we provided you via email or telephone. We will only lock in a price once you provide us a valid tracking number and the contents of the package using USPS Express Mail. One business day after evaluation and certification, we will send you a company check using the US Postal Service. Our pickup at the post office is 8:00 am Monday – Friday. Any items received by the post office after 8:00 am will be picked up and recorded by us as received the next business day. All telephone calls for purchases and sales may, at the sole discretion of PPM, be recorded.
2b. Sale of Precious Metal Bullion bars/coins. When we sell you precious metal bullion bars or coins we will send you your items using a carrier of our choice and will be sent with signature required. Items will be shipped to the customer 1-3 business days after funds have cleared the banking system. If you are a first time customer of PPM, we will lock in your price once funds have been received and cleared the banking system. Pricing for returning customers will be locked in at the time of order. Returning customers are obligated to send funds once placing an order. All telephone calls for purchases and sales may, at the sole discretion of PPM, be recorded.
2c. Purchase and Sale of Jewelry and Precious Metal Scrap. When we receive your items, we will evaluate them in the manner that we describe on our website. Based on that evaluation, we will propose a price that we will pay to buy the items from you. Our payment is based on gold content (karat), weight, and the spot price of gold on the day we receive your shipment. If you have brought the items to us directly at our storefront or we have provided in-home service, we will complete the transaction with you in person. If you have mailed them in, we will send you an email with the price that we are willing to pay for the items. We may, at our option also attempt to call you by telephone, but whether or not we actually reach you, the purchase and sale process and this agreement will not be affected. Phone offers may, at the sole discretion of PPM be recorded. You may, within fifteen days of the day on which we send you the email with the offer price, inform us that you do not want to make the sale. In that case, we will return the items to you, as provided in the website. If you do not notify us that you do not want to sell, we will complete the sale as provided on the website and send you your payment. Once the sale is completed, it is final, binding, and irrevocable. Your items will no longer be available to you. Within such fifteen-day period, you are welcome to call us to inquire about your items, but such a call will not affect or extend the fifteen-day period, unless we agree in writing and send you another email.
3. Lost Items. Our precious metals return pack is provided to help assure the safest transport of your scrap jewelry or scrap precious metals. It is not intended for any bullion products and we will not cover bullion products using this envelope. Our return pack includes a pre-paid, US Postal Service reinforced envelope that confirms delivery when it arrives at our facility. We insure your items up to $300 when you use our return pack. If you estimate your jewelry and other scrap precious metal items exceed $300, you should take your pack to the post office and insure it for the value you believe its worth. In addition, if you use your own envelope to send us your items, you must insure at the amount you believe is appropriate and send it registered mail with signature required upon delivery. If we return your items to you, we ship them to you using the US Postal Service. We will insure your items up to the lower of our appraised value or the amount you insured the pack for at your own cost when sending it to us. If your items, coming to us or coming from us to you, arrive damaged or if they are lost in transit, we are not responsible. If you used your own packaging to send us your scrap items, we will help you file an insurance claim, if possible, but that is our only liability. We will file a claim with the US Postal Service if your item was lost or damaged in our mailing envelope during transit. You are responsible to provide us with all documentation needed if your items are lost using our provided envelope, which will include a receipt showing the value of the items shipped. Failure to provide us with documentation will likely result in us unable to make a claim with the US Postal service and hence unable to pay you for the insured amount. In all cases, we will do our best to resolve the issue with you, our customer.

4. Our Liability. EXCEPT IN THE EVENT OF OUR WILLFUL MISCONDUCT, IN NO EVENT, AND REGARDLESS OF THE THEORY OF LAW UNDER WHICH A CLAIM IS MADE, WILL WE BE LIABLE TO YOU, YOUR AGENTS, REPRESENTATIVES, OR ANYONE CLAIMING THROUGH YOU FOR MORE THAN $300 AND WE SHALL IN NO EVENT BE LIABLE FOR ANY SPECIAL, PUNITIVE, EXEMPLARY, INCIDENTAL OR INDIRECT DAMAGES EVEN IF SUCH DAMAGES WERE FORESEEABLE. YOU HEREBY RELEASE US FROM ANY DAMAGES BEYOND THOSE ALLOWED IN THIS PROVISION.
5. Our Intellectual Property. The materials on this web site are copyrighted. No part of this web site may be copied, reproduced, or distributed without the prior written permission of PPM. You, however, may download or print one copy of one or more pages contained in this web site for your private, noncommercial use.
6. Changes To These Terms, Our Service, or This Website. We may change these terms and conditions, our service offering, or other information on this website at any time and such changes shall become effective as of the time they are posted to this website. You may not alter, delete, add or change or edit any of these terms and conditions, and any such attempted alteration shall be void and of no effect.
7. Third Party Material and Information. We provide links on this website to information and data developed by or provided by third parties and we post, for information purposes only, information and data developed by or provided by third parties. You agree that we are not responsible for the accuracy of such information and data and that we cannot and do not control it. We do not make and promise, representation or warranty about such information. If we provide links to third party websites or if there is any advertising on our website, you agree that we do not own or control such third party sites and we are not responsible for the content on such sites. We do not supervise or very any information provided by third parties and you should exercise reasonable judgment in using such information and relying on information and services from such third parties.
8. Use of Your Information / Privacy Policy. By using this website or contacting us for evaluation of your items, you authorize us to contact you by electronic mail, United States Mail, courier services, or telephone, in order to provide you services or propose services to you. We may use information about you (demographic information) that does not personally identify you, for our business needs. However, we do not collect, sell, trade, or give away any of your personal information in any way. This website may set cookies on your computer to help you navigate while on our site. We are not responsible for the privacy practices, content or lawfulness of any third party sites. You grant us the right to send you emails that advertise or provide information about our services. You may withdraw that right by sending an email to This e-mail address is being protected from spambots. You need JavaScript enabled to view it and requesting your email address to be removed from our mailing list.
9. This Is Our Agreement. These terms and conditions, along with the other notices to you on our website, constitute the entire agreement between PPM and you. This agreement supersedes all prior written and oral understandings, writings, and representations between us. We may be charged with any other agreement or any change only if we agree in writing.
10. Venue and Jurisdiction. This Agreement shall be governed by and construed under the laws of the State of California and the United States as applied to agreements between California state residents entered into and to be performed within the State of California, except as governed by Federal law. In case of any litigation regarding this Agreement, you agree that the venue for such litigation shall be either in the California State Courts or the Federal District Court whose venue includes Mill Valley, California.
